As New York Debates Secure Communities Program, Study Challenges Controversial Policy to Deport Immigrant Prisoners
What is Secure Communities?
Secure Communities is a DHS program designed to identify immigrants in U.S. jails who are deportable under immigration law.  Under Secure Communities, participating jails submit arrestees’ fingerprints not only to criminal databases, but to immigration databases as well; allowing ICE access to information on individuals held in jails. Unlike other ICE-local partnerships, Secure Communities gives ICE a technological, not physical, presence in prisons and jails.  No Memoranda of Agreement (MOAs) with local law-enforcement agencies are required, and no local law-enforcement agents are deputized to enforce immigration laws through Secure Communities. 

As of October 2010, Secure Communities is available in 686 jurisdictions in 33 states.  ICE plans to have a Secure Communities presence in every state by 2011, and plans to implement Secure Communities in each of the 3,100 state and local jails across the country by 2013.

A week before leaving office, Gov. Bill Ritter Jr. announced Tuesday that Colorado would participate in a federal background check program devised to catch illegal immigrants who have committed crimes. The announcement comes after months of debate in Colorado over the program — known as Secure Communities — which allows local law enforcement officials to check the immigration history of those they arrest in a government database.

Gov. Bill Ritter on Tuesday approved the use of a divisive federal program that identifies illegal immigrants through the fingerprints of every person booked into jail, angering dozens of groups and lawmakers who argue it will lead to unjust deportations and racial profiling. Ritter made the announcement with little fanfare, sending word of his decision by e-mail after several months of deliberation.
